VESUVIODRIVE SRLS provides bicycle rental and tour organization services. Users must adhere to the specific conditions for each service.

4. Applicability

These Terms and Conditions are applicable to all users of vesuviodrive.com, including non-registered visitors and registered users who make reservations through our site.

5. Prices/Offers

The prices of the services offered on vesuviodrive.com are indicated on the site itself and may be subject to change without notice. Any special offers are valid only for the specified period or until availability is exhausted

6. Cancellations and Returns

Users can cancel reservations according to the conditions explained in the service description. In some cases, cancellation penalties may apply. In case of cancellation by VESUVIODRIVE SRLS, users will be entitled to a full refund or alternative solutions, where possible.

7. Electronic Communications and Testing

8. Force Majeure

VESUVIODRIVE SRLS will not be held responsible for failure to fulfill its obligations caused by force majeure events such as natural disasters, terrorist acts, wars, strikes, epidemics, pandemics or any other event beyond the reasonable control of VESUVIODRIVE SRLS.

9. Other provisions

If any provision of these Terms and Conditions is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. These Terms and Conditions constitute the entire agreement between the user and VESUVIODRIVE SRLS regarding the use of the site and its services.

10. Changes

VESUVIODRIVE SRLS reserves the right to modify, update or correct any part of these Terms and Conditions, including prices and descriptions of services, at any time and without notice. Your continued use of the site after any such changes will constitute your acceptance of the changes.

Bike Rental Contract

The rental and use of the pedal-assisted bicycle presupposes the knowledge and unconditional acceptance by the user of these regulations, of the rates, of the opening and closing times of Vesuviodrive Srls, owner of the property, with headquarters in BoscoTrecase, via Panoramica 26 - P.iva 10341731213.

 

Your Agreement

  1. To obtain the rental of a pedal-assisted bicycle, the user must present a valid identity document in advance and formalize the contract. The rental is reserved for adults unless the minor is accompanied by an adult who assumes full responsibility for it.
  2. The use of the bicycle presupposes the physical fitness and technical expertise of the person who intends to ride it. Therefore, by renting the bicycle, the user declares to be equipped with adequate capacity and appropriate competence, without placing any reservations.
  3. The bicycle is to be used exclusively as a means of transport and must be treated with care, common sense and diligence, in order to avoid damage both to it and to its accessories. It is forbidden to use the bicycle for commercial activities, nor is it possible to transfer it for use to other parties.
  4. The user is responsible for the electric bicycle until it is returned to the Manager; He is also solely responsible for any facts, damages, injuries, accidents caused to himself, the bicycle, third parties and things during the use of the vehicle. No form of compensation may be requested from the Manager.
  5. The user is required to comply with the rules of the Highway Code. The Manager declines any form of responsibility in the event of improper use of the vehicle or failure to comply with the rules of the Highway Code.
  6. The Operator may carry out checks on Users during the use of bicycles and may request their return if it deems the conditions of improper use of the vehicle. The Manager may refuse the rental to persons in a state of drunkenness or under the influence of drugs (in accordance with articles 186-187 of the Highway Code) and for other reasons at the sole discretion of the Manager.
  7. In the event of loss of bicycle keys or accessories or damage, the Manager will request from the Customer the sum necessary for the original restoration of the vehicle, based on the supplier's price list and estimate; in the event of total theft, the user must compensate the Manager for the amount established.
  8. The bicycle must be returned, in compliance with the times communicated, in the same place where it was rented. The bicycle is considered returned only if it is returned directly to the Manager; It cannot be considered as a return of the parking of the electric bicycle outside the rental point during closing hours. Failure to return the bicycle without prior notice or in any case not motivated by exceptional cases, will be considered as a crime of theft and therefore reported to the Judicial Authority.
  9. The user may request an intervention from the Manager for the collection of the bicycle, the cost of which is to be agreed; the Operator is not required to intervene, therefore failure to intervene cannot be a cause of non-compliance. It is in the interest of the Manager to proceed with the collection of the bicycle and only momentary contingencies can make the intervention impossible.
  10. The User must pay the relevant payment from the time of the start of the rental until he presents himself for the closing of the rental agreement, in addition to any charges for damage, total or partial theft.
  11. In the event of theft of the electric bicycle, the User must submit to the Manager a copy of the report made to the competent authorities and pay the amount equal to the value of the stolen bicycle (see Art. 7), which will be returned to him in the event of discovery or recovery of the vehicle itself. For anything not mentioned in these regulations, the relationship between the Parties (contracting parties) is governed by the provisions of the Civil Code. For any dispute arising between the Parties, the competent court is that of Torre Annunziata.
  12. Both parties undertake to maintain the secrecy of information relating to the activities of the other party. This obligation of confidentiality shall not apply to information that has become publicly available. All in compliance with the provisions of Legislative Decree no. 196 of 30 June 2003

TO THIS END, DECLARES pursuant to and for the purposes of articles 38 and 47 of Presidential Decree no. 445 of 28.12.2000 and aware of the consequences, including criminal consequences, provided for in the event of false declarations of articles 75 and 76 of the same Presidential Decree to have read the rental price list, services and the current regulations indicated above for the provision of the bicycle rental service which constitutes, for all legal purposes, a user contract, whose general contractual conditions declares, in accordance with current regulations, to know and accept, with particular reference to the consequences incumbent on the renter in the event of damage caused, during the use of the vehicle, to himself, to the rented bicycle, to third parties and property and to the exemption of the manager's liability, pursuant to Article 1341, paragraph 2, of the Civil Code, which are approved in writing at the time of signing this application form; to be informed, pursuant to Article 7 of Legislative Decree 30
